Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you and AODA Training (“we,” “us,” or “our”) governing your access to and use of our website, training platform, audit services, and all related services (collectively, the “Services”).

By accessing or using our Services, you confirm that you are at least 18 years of age, that you have the authority to enter this agreement on behalf of your organization where applicable, and that you agree to be bound by these Terms. If you do not agree, do not use our Services.

Description of Services

AODA Training provides online accessibility compliance training, WCAG audits, remediation services, compliance documentation, and related consulting for organizations operating in Ontario and Canada. Our Services include:

Accounts and Registration

To access certain features of our platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update your information as needed. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Notify us immediately at support@aoda-training.ca if you suspect unauthorized access to your account.

Payments and Subscriptions

Pricing

Pricing for our Services is as displayed on our website at the time of purchase. We reserve the right to change pricing with 30 days’ notice to existing subscribers. New pricing will not apply to active subscription terms already paid for.

Payment terms

Payment is due at the time of purchase for one-time services. For subscription services, payment is charged at the start of each billing cycle. All prices are in Canadian dollars and exclude applicable taxes.

Refunds

Requests for refunds must be submitted within 14 days of purchase. Refunds are available in full where the Service has not been substantially accessed or delivered. Partially used training licences and completed audit engagements are non-refundable. To request a refund, contact billing@aoda-training.ca.

Intellectual Property

All content on our website and platform — including course materials, audit methodology, templates, reports, text, graphics, logos, and software — is owned by or licensed to AODA Training and is protected by Canadian copyright law. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any of our content without express written permission.

You retain ownership of any content or data you upload to our platform (“User Content”). By uploading User Content, you grant AODA Training a limited, non-exclusive licence to use that content solely for the purpose of delivering the Services you have requested.

Our Services are provided to assist organizations in working toward AODA compliance. We do not guarantee that use of our Services will result in full legal compliance, as compliance depends on factors outside our control including how our guidance is implemented by your organization.

Our website and platform are provided on an “as is” and “as available” basis. We do not warrant that the Services will be uninterrupted, error-free, or completely secure.

Limitation of Liability

To the maximum extent permitted by applicable law, AODA Training and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our Services, even if advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising from these Terms or your use of our Services shall not exceed the amount you paid to us in the 12 months preceding the claim.

Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms. You may terminate your account at any time by contacting support@aoda-training.ca. Upon termination, your right to access the platform ceases. We will retain your training records for 7 years to support AODA compliance documentation requirements and provide them to you on request.

Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.

Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email to registered users at least 14 days before they take effect. Continued use of the Services after the effective date of any update constitutes acceptance of the revised Terms.
